Job Description:

The principal duties and responsibilities assigned to this position are in keeping with the State University System’s stated requirements and national best practices —that is, this position is responsible for managing and coordinating a compliance program designed to ensure compliance with laws, regulatory requirements, policies, and procedures for the University of Florida enterprise, including all of its affiliated entities.  As the compliance leader and subject matter expert, this position is responsible for establishing standards and implementing procedures to ensure that the compliance programs throughout the UF enterprise (including UF, its direct support organizations and affiliated entities) are effective and efficient in identifying, preventing, detecting, and correcting noncompliance with applicable laws and regulations.  This position is also expected to provide reasonable assurance to senior management and the Board of Trustees that there are effective and efficient policies and procedures in place, which are generally understood by employees, and that the University is complying with all regulatory requirements.

ESSENTIAL FUNCTIONS OF THE JOB AND THE PERCENTAGE OF TIME SPENT ON EACH FUNCTION:

Coordinating and working collaboratively with compliance leaders across the UF enterprise (e.g., EHS, research, hospital, athletics, privacy, billing, finance) to collaboratively develop shared tools, best practices and resources, develop coordinated and streamlined practices/procedures/services to minimize the burden on regulated faculty and staff (e.g., by eliminating duplication of training content, providing centralized web-based guidance and resources), and test and monitor effectiveness of systems and remediation of weaknesses and particular violations.  

Serving as UF’s Privacy Officer and overseeing UF’s Clery, Title IX and Conflicts of Interest/Outside Activities functions, including managing daily operations of the programs; development, implementation, and maintenance of policies and procedures; monitoring compliance with relevant federal and state laws; and investigation and tracking of incidents, complaints, reports, and breaches.

Reviewing and analyzing trends in laws and regulations relating to compliance obligations, while assessing UF programs and operations to ensure investment in strategic priorities in a risk-based manner.  Developing an annual compliance work plan that reflects the University’s unique characteristics.  Periodically revising the compliance plan in light of changes. Leading periodic external review of the compliance program and reporting results to the Board.

Providing guidance, advice, and/or training and educational programs to improve the University’s understanding of related laws and regulatory requirements.

Preparing and presenting clear and concise compliance reports to the Board.

Developing policies and programs that encourage managers and employees to report suspected fraud and other improprieties, without fear of retaliation.

SUPERVISION

Reporting to the Vice President and General Counsel.  Provided general directions only.

Supervises UF Compliance office and Privacy office staff.  Supervises, with entity leadership, hospital and healthcare compliance, research compliance and financial compliance functions.

NORMAL WORK SCHEDULE

8 a.m. to 5 p.m., M-F, late hours and weekends, as needed

REQUIRED LICENSES, CERTIFICATIONS, AND OTHER SPECIFIC REQUIREMENTS OF LAW. 

Must be a member of the Florida Bar or become a member within twelve months of employment.

This position is responsible for meeting the requirements of University of Florida Regulation 3.022 - Payment to Vendors; Payment Processing Guidelines, as amended, regarding the approval and/or processing of vendors' invoices and/or distribution of warrants to vendors. 

Expected Salary:

Salary commensurate with education and experience.

Minimum Requirements:

Juris Doctor degree and eight years of experience as a practicing attorney.

Preferred Qualifications:

Experience as practicing attorney in a leadership role that involves oversight and management of legal staff and complex legal matters.
