Strengths and weaknesses of land consolidation: identification and proposed solutions

Theses:
Comparison of land consolidation (LC) projects within Slovakia in order to find out the reasons for their different duration.
Analysis of the LC process and comparison with selected EU countries based on methodological procedures, time and financial demands.
Analysis of the causes of ownership fragmentation in the compared countries; differences in inheritance laws.
Comparison of legislation (De lege lata) on land consolidation in the Slovak Republic and selected states.
Comparison of procedures (De lege ferenda) for land consolidation in the Slovak Republic and selected states.
Analysis of the approach of subjects in the state administration / public administrative bodies and participants in the projects (with a specific focus on the Slovak Land Fund as the property manager of the Slovak Republic and unknown and unidentified owners).
Proposals for changes in procedural and methodological conditions with the aim of improvement and acceleration of LC.
Rationale:
Land ownership in Slovakia represents a big barrier not only for investments in property, when land owners are unable to realistically realize their ownership rights, but also for public interests, especially in landscape design and protection. The reasons for this state of affairs arise from historical development and the inheritance model based on Hungarian law, according to which each of the descendants becomes an heir in equal shares. The solution to this situation is implementing land consolidation projects, that, however, are facing a complicated period of stagnation.
It is necessary to look for solutions to improve and streamline the land consolidation process as a complex tool for eliminating the fragmentation of land ownership, which also resolves the new organization and protection of the territory. Practice shows that it is necessary to optimize legal and methodological procedures, which are often burdened with excessive administration and also approaches that do not reflect new trends.
The goal shall be an objective scholarly evaluation of the real situation and activities of the land consolidation process for gaining an overview of the weak and strong aspects and then pointing out the procedures that should be modified legislatively and methodically.

Tézy:
Komparácia konaní o pozemkových úpravách (PÚ) v rámci Slovenska za účelom zistenia dôvodov ich rozdielnej časovej náročnosti.
Analýza procesu PÚ a porovnanie s vybranými krajinami EÚ na základe metodických postupov, časovej a finančnej náročnosti.
Analýza príčin vzniku rozdrobenosti vlastníctva v porovnávaných štátoch, porovnanie dedičského práva.
Porovnanie legislatívy (De lege lata) na úseku pozemkových úprav v SR a vybraných štátoch.
Porovnanie procesných postupov (De lege ferenda) na úseku pozemkových úprav v SR a vybraných štátoch.
Analýza prístupu subjektov na úseku štátnej správy/správnych orgánov a účastníkov konania (so špecifickým zameraním na Slovenský pozemkový fond ako správcu majetku SR a neznámych a nezistených vlastníkov).
Návrhy na zmeny procesných a metodických podmienok s cieľom zlepšenia a urýchlenia procesu PÚ.
Zdôvodnenie :
Pozemkové vlastníctvo na Slovensku predstavuje veľkú bariéru nielen pri investíciách do majetku, kedy vlastník pozemku nemôže svoje vlastnícke práva reálne uskutočňovať, ale aj pri verejných záujmoch, najmä pri tvorbe a ochrane krajiny. Dôvody tohto stavu vyplývajú z historického vývoja a dedičského modelu vychádzajúceho z uhorského práva, podľa ktorého sa stáva dedičom každý z potomkov rovnakým dielom. Riešením tohto stavu sú pozemkové úpravy, ktoré však prechádzajú komplikovaným stagnujúcim obdobím.
Je potrebné hľadať riešenia na zlepšenie a zefektívnenie procesu pozemkových úprav ako komplexného nástroja na odstránenie rozdrobenosti pozemkového vlastníctva, ktorý zároveň dorieši aj novú organizáciu a ochranu územia. Prax ukazuje, že je potrebné optimalizovať konania procesné aj metodické, ktoré sú častokrát zaťažené nadmernou administratívou a aj postupmi nereflektujúcimi nové trendy.
Cieľom bude objektívne akademické zhodnotenie reálnej situácie a činností procesu pozemkových úprav za účelom získania prehľadu o slabých a silných stránkach, následne poukázať na postupy, ktoré je potrebné/nevyhnutné legislatívne aj metodicky modifikovať.
