As part of the Subsoil “Priority Research Programme and Equipment” (PEPR), co-managed by BRGM and CNRS, BRGM is looking for a person to take part in the implementation of the”‘Legal Regulations” project. The Subsoil PEPR is divided into several targeted projects, and brings together a large community of researchers in the Earth and environmental sciences, as well as in the social, environmental, economic and legal sciences. This interdisciplinary research programme examines the use of the subsoil as a common good. The increasing demand for the resources it contains and the advent of new technologies for exploiting sub-surface space underscore the necessity to establish responsible and sustainable conditions for using the subsoil.

The “Legal Regulations”' research project, coordinated by the Université de Pau et des Pays de l'Adour in partnership with BRGM, focuses specifically on mining law. Its aim is to understand the current legal frameworks, both national and European, and to propose necessary and desirable changes for the development of an appropriate European trajectory. One of the key aspects of this research project involves analysing legal tools designed to ensure the responsible and equitable nature of mining projects. This position is available within the Legal Unit of the BRGM.

 

The role of this unit is to ensure the legal security (excluding social and tax law) of all the contractual acts of the Institution and, where necessary, of certain subsidiaries. It is also involved in ensuring the compliance of these structures. You will work in close collaboration with the entire community of researchers involved in the Subsoil PEPR. You will be supported in your role by other legal professionals at BRGM and will work in close collaboration with members of the Georesources Department whose work focuses on the theme of “Responsible mining”.

Joining the French Geological Survey (BRGM) means becoming part of France's leading public institution for Earth Science applications bringing together 1,000 wholeheartedly committed experts across 29 bases in Mainland and Overseas France.

BRGM focuses on enhancing geological knowledge and understanding of surface and sub-surface-related phenomena, with a view to:: meeting the challenges of environmental changes through innovative projects with societal implications.

As part of your duties, your main responsibilities will be as follows: - Research and publications on responsible mining and responsible sourcing :

a. Analysis of standardisation work regarding best practices in the mining sector and their level of integration into legal frameworks;
b. Analysis of the current and future European legal framework (CRM Act) and the feasibility of assessing liability criteria in the context of a mining project in Europe and France;
c. Analysis of responsible sourcing obligations for mineral resources: international framework, legal aspects, non-financial reporting obligations for companies (CSRD, duty of care directive, etc.), impact of the “responsible sourcing” component of national policy;
- Leading a forward-looking working group (WG) on the future of mining law in collaboration with the administration and other stakeholders: the WG will meet several times a year with the aim of identifying emerging study areas, particularly in relation to the responsible sourcing of primary and secondary resources, etc.
Expected deliverables:
* Published articles;
* Annual report on developments in mining law within the WG on the future of mining law;
* Participation in the organisation of conferences, etc.

Skills/Qualifications

You have a PhD. in law with a specialisation in private law or public law, possibly in political science. You have in-depth knowledge in environmental law, mining law, energy law, or corporate social responsibility law.

You will demonstrate the following skills and abilities :

• Proficient in office tools with impeccable spelling;
• Curious, open-minded, precise, methodical, dynamic, and mobile, able to work as part of a team;
• Strong interpersonal skills, diplomacy, sense of confidentiality and anticipatory mindset will enable you to integrate fully in a demanding environment.
